Purchasing Contracts

The most frequent and common manner obtaining a realty. With the realty buying and selling the seller transfer against an exchange to the buyer the realty and he becomes the main master, occupant and owner. If there is not an exchange it is not a purchase and it is a charity.

Basic steps that MUST be careful in every purchase :

A) Realty Check, full and detailed. The check must be :
1. Juridical chaeck, proof check and titles.
2. Town-Planning check singurarly on building plots.
3. Real condition check (antiquity, delimitation singurarly on building plots).
4. Legalization check hereof transfering, specially on the companies.
5. Economical solventness check of the seller.
6. Cadastre. Declaration check of the cadastre.

B) Lease check in the realty transfer.
1. In a new building construction the buyer securenness of a on time delivery.
2. Penalty clause in the case of non on time delivery of the under construct building.
3. In case of credit the cost, permit mortgaging.
4. In case of buying with a loan, pre-registration from the Bank of the borrower, with
specification of the borrowing price for the purchasing realty.

C) Full element check of the seller and of the perhaps power of attorney document.

D) Building licence check and the designs.

E) Full and detailed check of the uses in case of specific law clauses for the professional realties.
